These terms and conditions (“Terms”) govern your use of our website and the purchase of any products from our online store. Please carefully read all the details given in this section. You expressly agree to comply with and be bound by these terms and conditions by accessing or using our website. If you do not agree with any of the Terms, please do not use the Amyzel Platform. 

For the purpose of these Terms: (a) “Amyzel Platform” means www.amyzel.com and its  associated mobile application/website/tablet/desktop or any other digital mode and/or operating system that we provide, on which you can access the Services; it also includes our controlled and managed applications that interface with one or more of these mobile applications/websites/tablets and digital modes; (b) All furniture, carpet and other goods that are available for purchase on the Amyzel Platform are referred to as “Products.”

Kindly go over each section carefully to understand the Terms that apply when using the Amyzel Platform and when purchasing its products.

1. General

1.1 These Terms and Conditions constitute a legally binding agreement between the “Customer” and “Amyzel”. In this Terms and Conditions, Shipping and Delivery Policy, Return, Refund and Cancellation Policy, Privacy Policy and all other agreements of the Amyzel Platform, “Client”, “Customer”, “You” and “Your” refer to you, the person who has logged in to this website and is compliant with the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company (Amyzel).

1.2 Amyzel at its sole discretion reserves the right to update or modify these Terms and Conditions and any Policy mentioned at Amyzel Platform at any time without prior notice. Your continued use of the website following any changes made constitutes acceptance of those changes. Please check these Terms of Use each time you want to use Amyzel Platform to make sure you are aware of the Terms and Conditions that are in effect at that particular moment.

1.3 A breach or violation of any of the Terms will result in immediate termination of your Services.

2. Acceptance of Terms 

By using this website, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. 

By agreeing to this Agreement, you also confirm that you are at least 18 (Eighteen) years old and have the legal capacity to enter into and adhere to this Agreement. If you are under 18 (Eighteen), it is expected that you are accessing or using the Amyzel Platform under the supervision of a parent or legal guardian who has reviewed and accepted the terms of this Agreement on your behalf, including those related to purchasing products. If it is discovered that a user under the age of 18 is using our platform without such supervision, we reserve the right to deactivate the account without prior notice. Additionally, if you are utilizing the Services for a company or organization, you attest that you have the authority to do so and that the entity you represent agrees to this Agreement. 

3. User Accounts

3.1. Account Creation

To place orders, you may be required to create an account or checkout as a guest. To create an account on our website, you must be at least 18 years old. Registration is a one-time process. You must provide accurate and complete information during the registration and checkout process. 

3.2. Account Responsibility

You are responsible for maintaining the confidentiality of your account details and its password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Neither we nor our employees, agents, directors, or officers will be responsible for any loss or direct or indirect damage resulting from your failure to adhere to these Terms of Use. You may be held accountable for any losses sustained by us or other users due to unauthorized use of their accounts by you.

4. Orders and Payments

All orders are subject to acceptance by us and their availability. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information.

4.1. Order Placement 

To place an order, select the desired items and add them to your cart. Follow the prompts to complete the checkout process.

4.2. Payment Methods

Payment must be made in full at the time of purchase using one of the payment methods available on our website. We accept various payment methods such as credit cards, debit cards, and other secure online payment options.

4.3. Order Confirmation

Once the full payment is received, only then the order shall be confirmed. Please note that this confirmation does not allow you to resell our products.  

4.4. Cancellation and Modification

Once you have placed the order for any product, you may cancel or modify your order only within 24 (twenty four) hours. After the passage of this time, orders will not be canceled and no refund will be provided as most of our products are handmade and made to order. Please contact our customer support for assistance.

5.1. Shipping Policy

We offer FREE All India Shipping. 

5.2. Delivery Timeframes

Delivery times vary depending on the destination. The standard processing time is 21 business days. Please note that these are only estimated times and real delivery dates could differ based on circumstances that may be beyond our control like courier delays.  As our products are handmade and are made to order, you also agree that sometimes the delivery of the product may be delayed 2 to 3 times than what has been promised. 

5.3. Shipping Charges

We provide Free Delivery on the ground floor. For delivery on any other floor please contact our customer service as there might be an additional charge for it.

7. Product Descriptions, Customization and Pricing

7.1. Accuracy of Information 

We strive to describe our products and display their colours and images as accurately as possible, but it may slightly vary because of lighting, and also the wood texture may differ. We do not guarantee that the product description, colour information, or other content of the Amyzel Platform is accurate, error-free, and complete. 

7.2. Errors, Omissions and Inaccuracies 

As it is managed by human resources, there may be information on our site or within the Service that includes typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any errors, omissions or inaccuracies and to modify or update information or cancel orders if any information in the Service or on any associated website is inaccurate at any time without prior notice, even after you have submitted your order.

7.3. Customization

All our products can be customized. Please speak with our customer care executive to know the customisation charges.

7.4. Visual Representation Disclaimer

Colour Accuracy

  • We make every effort to ensure that the colours of our products are represented as accurately as possible on our website. However, due to variations in computer monitors, mobile devices, and other display technologies, the colours you see on your screen may not exactly match the actual colours of the products.
  • Differences in lighting conditions during photography, monitor settings, and other factors may result in slight discrepancies between the visual representation and the actual product colours.

Product Images

  • The images of products on our website are for illustrative purposes only. While we strive to provide high-quality and accurate images, some products may appear slightly different in reality.
  • Any accessories or items shown in product images are not included unless explicitly specified in the product description.

Product Dimensions

  • We aim to provide accurate product dimensions in our descriptions. However, please be aware that measurements are approximate and can vary slightly due to the manufacturing process.
  • We recommend using the provided dimensions as a general guide and considering the space requirements for assembly and use.

Material and Finishing

  • The texture and finish of materials used in our products may differ slightly from the images displayed on our website due to natural variations in raw materials and manufacturing processes.
  • We cannot guarantee that the finishing and appearance of the products you receive will be exactly as depicted in the online images.

Assembly and Installation

  • Our furniture products require assembly. However, assembly is easy. You can do it yourself as we provide necessary instructions and assembly tools. 

Screen Settings and Resolution

  • The resolution and settings of your screen can affect how images and colours are displayed. Higher resolution screens may provide more accurate representations of product details.
  • We suggest viewing our products on multiple devices or screens to get a more accurate sense of their true appearance.

By using our website and purchasing our products, you acknowledge and accept that the actual product may vary from its visual representation on the website. 7.5. Pricing

All prices are listed in Indian Rupees and include applicable taxes unless otherwise stated. We reserve the right to change prices at any time without prior notice. The prices mentioned at the time of ordering will be the final price charged to you. 

8. Intellectual Property

8.1. Ownership

All content on this website, including text, graphics, logos, and images, is the property of Amyzel and is protected by intellectual property laws.

8.2. Usage Restrictions

You must not use, sell, reproduce, republish, or distribute any content from this website without our prior written permission.

9. Personal Information

We are committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

10. Warranties 

All our furniture products come with a lifetime termite resistant warranty. The manufacturing defects must be reported within 48 hours via email of receiving the product for repair or replacement depending upon the severity of the damage. This warranty does not cover damage caused by misuse, accidents, or normal wear and tear. 

All our carpet products come with a warranty against manufacturing defects only. It needs to be reported within 48 hours via email of receiving the product for repair or replacement depending upon the severity of the damage. The products with manufacturing defects will be replaced (if applicable) or repaired, there is no provision of refund in this case.

11. Limitation of Liability and Indemnification

You explicitly consent that your use of, or inability to utilize, the service is solely at your own risk. The service, along with all products and services provided to you are based on “as is” and “as available”, without any representation, warranties, or conditions of any kind, whether express or implied. 

You agree that under no circumstances shall Amyzel, our officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall be liable for any harm, loss, claim (including reasonable attorney fees and costs), or any kind of direct, indirect, incidental, punitive, special, or consequential damages, including, but not limited to, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products purchased using the service, or for any other claims relating in any manner to your use of the service or any product, including but not limited to any content errors or omissions, loss or damage of any kind resulting from the use of the products and services, or from any content (or product) uploaded, transmitted, or otherwise made available via the service, even if such claims were advised to be possible. Our liability shall be limited to the extent allowed by law in states or jurisdictions where it is not permissible to exclude or limit liability for consequential or incidental damages.

You also agree to indemnify, defend, and hold harmless Amyzel, its CEO, officers, employees, agents, licensors, services providers and suppliers from and against all losses, claims, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from:

  • any violation of these Terms and Conditions either by you or other person accessing the website using your Internet account
  • any damage or injury resulting from your use or misuse of our products, including, but not limited to, improper assembly, modification, or unauthorized use.
  • any claim arising from any content or material you submit, post, transmit, or otherwise make available through our website, including but not limited to claims of defamation, invasion of privacy, intellectual property infringement, or fraud.

You agree to cooperate fully with us in the defence of any claim that is the subject of your indemnification obligations.

12. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India and all claims shall be subject to the exclusive jurisdiction of the Gyanpur District Court. You agree that any disputes arising out of or in connection with these Terms and Conditions shall be heard in the Gyanpur District Court, Uttar Pradesh – 221403, India.

13. Force Majeure 

We will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause that is beyond our reasonable control, including but not limited to:

  • Natural Disasters (e.g., floods, fires, earthquakes etc.) 
  • Acts of God
  • Civil unrest
  • Strikes, labour disputes, or other industrial disturbance
  • Supply chain disruption
  • Epidemics, pandemics, or any other public health emergencies

If any such delay or failure occurs, our obligations under this agreement will be suspended for as long as the force majeure event continues, and we will make all reasonable efforts to resume our operation as soon as possible.

14. User Conduct

14.1. Prohibited Activities

You agree not to:

  • use the website for illegal purposes
  • interfere with the website’s operation
  • post harmful or false content
  • encourage others to engage in illegal activity
  • violate any national and international laws
  • harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
  • upload or transmit any viruses or malicious code that may affect our operations
  • collect or track the personal data of others

14.2. User feedback and comments

  • You may post comments, and reviews, and give suggestions as long as they are related to our products only and are not abusive, objectionable, illegal or obscene in nature. You are responsible for the content you post, such as feedback, reviews, or comments. By posting, you grant us a license to use, reproduce, edit, and display this content in any form.
  • You agree that your comments do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material that is an invasion of privacy. You are solely responsible for the comments you make and their accuracy. We do not assume any responsibility or liability for any comments posted by you or any third party. We reserve the right to remove any content posted on our website if it violates any of our Terms and Conditions.
  • You agree that your comments will not infringe upon any third-party rights, including but not limited to copyright, trademark, privacy, personality, or any other personal or proprietary rights.
  • We are and shall be under no obligation to (a) keep any comments confidential; (b) provide compensation for any comments; or (c) respond to any comments.
  • You may not use a false email address, impersonate any person or entity, or otherwise mislead us or third parties regarding the origin of any comments.

15.1 By agreeing to the Terms of Use, you also consent to receive news, updates, and promotional SMS at the mobile phone number provided by you. By accessing and using the Amyzel Platform or verifying your contact number with us, you explicitly agree to receive such communications (via call, SMS, email, or other digital means) from us or our authorized representatives regarding new services or offers, even if your contact number is registered on the DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018.

15.2 You can unsubscribe or opt-out from receiving marketing and promotional communications, newsletters, and other notifications from us at any time by following the instructions provided in such communications.
