These terms and conditions (“Terms”) govern your access to and use of the Amyzel Platform and the purchase of any products from our online store. By using the Amyzel Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any of the Terms, please do not use the Amyzel Platform. 

For the purpose of these Terms: (a) “Amyzel Platform” means www.amyzel.com and its  associated mobile application/website/tablet/desktop or any other digital mode and/or operating system that we provide, on which you can access the Services; it also includes our controlled and managed applications that interface with one or more of these mobile applications/websites/tablets and digital modes; (b) All furniture, carpet and other goods that are available for purchase on the Amyzel Platform are referred to as “Products.”

Kindly go over each section carefully to understand the Terms that apply when using the Amyzel Platform and when purchasing its products. By using the Amyzel Platform, you also agree to be bound by all policies referenced here, including our Privacy Policy, Shipping and Delivery Policy, and Return and Refund Policy which are available on our website.

1. General

1.1 These Terms and Conditions constitute a legally binding agreement between the “Customer” and “Amyzel”. In this Terms and Conditions, Shipping and Delivery Policy, Return, Refund and Cancellation Policy, Privacy Policy and all other agreements of the Amyzel Platform, “Client”, “Customer”, “You” and “Your” refer to you, the person who has logged in to this website and is compliant with the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company (Amyzel).

1.2 Amyzel at its sole discretion reserves the right to update or modify these Terms and Conditions and any Policy mentioned at Amyzel Platform at any time by posting an updated version. Your continued use of the website following any changes made constitutes acceptance of those changes. Please check these Terms of Use each time you want to use Amyzel Platform to make sure you are aware of the Terms and Conditions that are in effect at that particular moment. The “Last Updated” date will be shown on this page.

1.3 A breach or violation of any of the Terms may result in temporary suspension or permanent termination of your access to our services.

By using this website, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. 

By agreeing to this Agreement, you also confirm that you are at least 18 (Eighteen) years old and have the legal capacity to enter into and adhere to this Agreement. If you are under 18 (Eighteen), it is expected that you are accessing or using the Amyzel Platform under the supervision of a parent or legal guardian who has reviewed and accepted the terms of this Agreement on your behalf, including those related to purchasing products. If it is discovered that a user under the age of 18 is using our platform without such supervision, we reserve the right to deactivate the account until appropriate consent is verified. Amyzel products are intended for general use. They are not marketed specifically to children under 13 years of age. Additionally, if you are utilizing the Services for a company or organization, you confirm that you have the authority to do so and that the entity you represent agrees to these Terms.

3. User Accounts

3.1. Account Creation

To place orders, you will be required to create an account or checkout as a guest. To create an account on our website, you must be at least 18 years old. Registration is a one-time process. You must provide accurate and complete information during the registration and checkout process. You must not create multiple accounts for fraudulent purposes or impersonate any individual or entity.

3.2. Account Responsibility

You are responsible for maintaining the confidentiality of your account details and its password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Neither we nor our employees, agents, directors, or officers will be responsible for any loss or direct or indirect damage resulting from your failure to adhere to these Terms of Use. You may be held accountable for any losses sustained by us or other users due to unauthorized use of their accounts by you.

4. Orders and Payments

All orders are subject to our acceptance and their availability. We reserve the right to refuse or cancel orders due to unavailability, pricing errors, suspected fraud, or other operational concerns.

4.1. Order Placement 

To place an order, select the desired items and add them to your cart. Follow the prompts to complete the checkout process.

4.2. Payment Methods

Payment must be made in full at the time of purchase using one of the payment methods available on our website. We accept various payment methods such as credit cards, debit cards, and other secure online payment options.

4.3. Order Confirmation

Once the full payment is received, only then the order shall be confirmed. Purchase of our products is intended for personal use only and not for commercial resale, unless otherwise authorized by Amyzel in writing.

4.4. Cancellation and Modification

You can cancel or modify your order within 24 hours of placing it by contacting our customer support team. After 24 hours, cancellations are no longer accepted as most of our products are handmade and made-to-order, and production may have already begun. 5.1. Shipping Policy

We offer FREE All India Shipping. 

5.2. Delivery Timeframes

We strive to process and ship orders as quickly as possible. The standard manufacturing time for all our handmade products is 21-28 days. Once the product is ready, shipping process is fast. The product will be shipped within 3 business days. Delivery times vary by location, typically ranging from 5-7 business days. While we aim to deliver within our stated timeframes, occasional delays may occur due to the handcrafted nature of our products. In such cases, our team will keep you updated. You may request a cancellation or refund if your order has not shipped within 50 days of purchase.

However, actual colours and textures may vary slightly due to individual screen settings, lighting conditions during photography, and the natural variations in materials like solid wood.

While we make every effort to ensure that all content on our website is up-to-date and accurate, we do not guarantee that all product descriptions or visual representations are entirely free from errors or omissions. If you have any doubts or require clarification before making a purchase, we encourage you to contact our customer support team for assistance.

7.2. Errors, Omissions and Inaccuracies 

We aim to provide complete and accurate information across our website, including product details, pricing, availability, and delivery timelines. However, due to the nature of manual updates and human oversight, there may occasionally be unintentional errors or omissions.

We reserve the right to revise or update any content—such as product descriptions, prices, offers, or stock status—at any time without prior notice. In cases where an update impacts an existing order, our team will contact you to offer a resolution, which may include order confirmation, modification, or cancellation with a full refund, if applicable.

Assembly and Installation

  • Our furniture products require assembly. However, assembly is easy. You can do it yourself as we provide necessary instructions and assembly tools. 
  • Our carpets do not require any assembly and are ready to use immediately upon delivery.

Screen Settings and Resolution

  • The resolution and settings of your screen can affect how images and colours are displayed. Higher resolution screens may provide more accurate representations of product details.
  • We suggest viewing our products on multiple devices or screens to get a more accurate sense of their true appearance.

All prices are listed in Indian Rupees and include applicable taxes unless otherwise stated. We reserve the right to change prices at any time without prior notice. The prices mentioned at the time of ordering will be the final price charged to you. 

8. Intellectual Property

8.1. Ownership

All content on this website, including text, graphics, logos, and images, is the property of Amyzel and is protected by intellectual property laws.

8.2. Usage Restrictions

You must not use, sell, reproduce, republish, or distribute any content from this website without our prior written permission.

9. Personal Information

We are committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

10. Warranties 

In the event of a manufacturing defect in carpets or wooden furniture, we recommend reporting the issue via email within 48 hours of delivery for prompt assistance. If the defect is verified, we will offer a repair or replacement, depending on the nature of the issue. In rare cases where neither option is feasible, a refund will be processed to the original payment method.

After sourcing, the wood used in our furniture is seasoned and treated to enhance its durability. Based on this process, we offer a 3-year limited warranty against termite damage, applicable for residential use and subject to proper care as outlined in our warranty policy.

11. Limitation of Liability and Indemnification

You agree that your use of our services is at your sole risk. Products and services provided to you are based on “as-is” and “as available”, without any representation, warranties, or conditions of any kind, unless explicitly stated. 

You agree that under no circumstances shall Amyzel, our officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors shall be liable for any harm, loss, claim (including reasonable attorney fees and costs), or any kind of direct, indirect, incidental, punitive, special, or consequential damages, including, but not limited to, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products purchased using the service, or for any other claims relating in any manner to your use of the service or any product, including but not limited to any content errors or omissions, loss or damage of any kind resulting from the use of the products and services, or from any content (or product) uploaded, transmitted, or otherwise made available via the service, even if such claims were advised to be possible. Our liability shall be limited to the extent allowed by law in states or jurisdictions where it is not permissible to exclude or limit liability for consequential or incidental damages.

You also agree to indemnify, defend, and hold harmless Amyzel, its CEO, officers, employees, agents, licensors, services providers and suppliers from and against all losses, claims, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from:

  • any violation of these Terms and Conditions either by you or other person accessing the website using your Internet account.
  • any damage or injury resulting from your use or misuse of our products, including, but not limited to, improper assembly, modification, or unauthorized use.
  • any claim arising from any content or material you submit, post, transmit, or otherwise make available through our website, including but not limited to claims of defamation, invasion of privacy, intellectual property infringement, or fraud.

You agree to cooperate fully with us in the defence of any claim that is the subject of your indemnification obligations.

12. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India and all claims shall be subject to the exclusive jurisdiction of the Gyanpur District Court. You agree that any disputes arising out of or in connection with these Terms and Conditions shall be heard in the Gyanpur District Court, Uttar Pradesh – 221403, India.

13. Force Majeure 

We will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause that is beyond our reasonable control, including but not limited to:

  • Natural Disasters (e.g., floods, fires, earthquakes etc.) 
  • Acts of God
  • Civil unrest
  • Strikes, labour disputes, or other industrial disturbance
  • Supply chain disruption
  • Epidemics, pandemics, or any other public health emergencies

If any such delay or failure occurs, our obligations under this agreement will be suspended for as long as the force majeure event continues, and we will make all reasonable efforts to resume our operation as soon as possible.

14. User Conduct

14.1. Prohibited Activities

You agree not to:

  • use the website for illegal purposes
  • interfere with the website’s operation
  • post harmful or false content
  • encourage others to engage in illegal activity
  • violate any national and international laws
  • harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
  • upload or transmit any viruses or malicious code that may affect our operations
  • collect or track the personal data of others

All communications will be in accordance with applicable laws, including the Telecom Commercial Communications Customer Preference Regulations, 2018 (DND/NCPR).

15.2 You can unsubscribe or opt-out from receiving marketing and promotional communications, newsletters, and other notifications from us at any time by following the instructions provided in such communications.
